29 CFR  1926.451(b)(1):Each platform on all working levels of scaffolds shall be fully planked or decked between the front uprights and the guardrail supports as follows:  a. Weaver Landscaping at a worksite located at 44135 Marietta Road, Caledonia, OH 43314: On or about March 21, 2023, the employer did not ensure that all working levels of a scaffold were fully planked or decked between the front uprights and the guardrail supports. A roofing crew using a two-tier scaffold approximately nine feet in height with a single plank/platform on each level of the scaffolding. The following condition exposed employees struck-by hazards should the scaffolding collapse.

29 CFR  1926.451(c)(2): Supported scaffold poles, legs, posts, frames, and uprights shall bear on base plates and mud sills or other adequate firm foundation.   a. Weaver Landscaping at a worksite located at 44135 Marietta Road, Caledonia, OH 43314: On or about March 21, 2023,   a two-tier supported scaffold on the first story roof of a commercial building was being utilized by roofers which did not have base plates or other adequate means for a firm foundation. The following condition exposed employees struck-by and fall hazards should the scaffolding collapse.

29 CFR  1926.451(f)(7): Scaffolds shall be erected, moved, dismantled, or altered only under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration. Such activities shall be performed only by experienced and trained employees selected for such work by the competent person.   a. Weaver Landscaping at a worksite located at 44135 Marietta Road, Caledonia, OH 43314: On or about March 21, 2023, the employer did not ensure a fabricated scaffold was erected by a competent person. Employees used the scaffold as a means of access/egress to the second story roof. The scaffold had not been erected under the supervision and direction of a competent person. The following condition exposed employees struck-by hazards should the scaffolding collapse.

29 CFR  1926.502(d)(11):Lifelines shall be protected against being cut or abraded.   a. Weaver Landscaping at a worksite located at 44135 Marietta Road, Caledonia, OH 43314: On or about March 21, 2023, the employer did not ensure that vertical lifelines used for fall protection at or near leading edges were protected against being cut. A vertical lifeline, rope grab was used as a personal fall arrest system (PFAS) by the roofing crew near 90 degree leading edges while installing a metal roof at heights beyond 6 feet. The lifeline was not protected from being cut by the 90 degree edge in the event of a fall. The following condition exposed the employee to falls of over 20 feet.
