29 CFR  1910.178(l)(2)(ii): Training shall consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.  a) On or about March 24, 2023, the employer did not ensure that forklift operators were given training that included practical training such as but not limited to driving exercises and an evaluation when operating forklifts such as but not limited to the Toyota Electric Forklift Truck Model and SN 9BDRU15 -36759, exposing employees to struck by hazards.

Powered industrial truck operators shall receive initial training in the following topics, except in topics which the employer can demonstrate are not applicable to safe operation of the truck in the employer's workplace. (i)(J): Any vehicle inspection and maintenance that the operator will be required to perform.  a)On or about March 24, 2023, the employer did not ensure that forklift operators were given initial training which addressed inspection and maintenance of forklifts such as but not limited to the Toyota Electric Forklift Truck Model and SN 9BDRU15 -36759 in that employees  operated forklifts with damaged tires, exposing employees to struck by injuries.

All repairs shall be made by authorized personnel.   a) On or about March 24, 2023, the employer did not ensure that power-operated industrial trucks not in safe operating condition were removed from service in that the Toyota Electric Forklift Truck Model and SN 9BDRU15 -36759 had tires front tires worn to the orange wear line with chunking and cuts, exposing employees to struck by injuries.

29 CFR  1910.132(d)(2):The employer shall verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated; the person certifying that the evaluation has been performed; the date(s) of the hazard assessment; and, which identifies the document as a certification of hazard assessment.  a) On or about March 24, 2023, the employer did not verify through a written certification that the required workplace hazard assessment had been performed for the fork truck operators working in the freezer warehouse.
