29 CFR 1926.602(c)(1)(vi): Industrial truck(s) in use did not meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks: A) On March 23, 2023 and dates prior at the White Buffalo Meadows Construction Site, Nespelem, WA 99155 the SkyTrak 6036 Telehandler in use was leaking oil and had damaged tires. B) On March 23, 2023 and dates prior at the White Buffalo Meadows Construction Site, Nespelem, WA 99155 the SkyTrak 6036 Telehandler in use had maintenance instruction plates, tags, or decals that were not legible. C) On March 23, 2023 and dates prior at the White Buffalo Meadows Construction Site, Nespelem, WA 99155 the SkyTrak 6036 Telehandler in use was not clean: cabin area contained debris, the seat was damaged and covered in debris and flammable material, and the rear of the truck was covered in oil stains. Employees who operated and worked near the industrial truck were potentially exposed to fire hazards and hazards associated with loss of control, due to the condition of the industrial truck.

29 CFR 1926.602(d): The employer did not certify, train, and evaluate each operator in accordance with 26 CFR �1910.178(l). Note: The requirements applicable to construction work under this paragraph are identical to those set forth at �1910.178(l) of this chapter. Reference standard 29 CFR 1910.178(l)(3)(ii)(B): Training program content: Powered industrial truck Operators did not receive initial training in the following work place related topics: Composition of loads to be carried and load stability: On March 23rd, 2023, at the White Buffalo Meadows Construction Site Housing Lot 7, Nespelem, WA 99155, an employee of Burly Products with a powered industrial truck (SkyTrak 6036 Telehandler) attempted to unload three large bundles of rolled metal roof shingles from the trailer of a delivery truck. The shingles were rolled metal units of various lengths, that were bundled together with wooden dunnage to be used on the house under construction. Three of the units consisted of shingles that were 58 feet long, packaged together with units of shorter length. The shingles were packaged in groups of 12 and stored vertically in the dunnage making the packages rigid from top to bottom, and front to back, but making the bundles very flexible and less stable when approached from the side. The space between the bed of the trailer and the wooden dunnage was not big enough for the tines of the forklift to fit in without the use of force. There was not enough space between the units of shingles to lift one unit without disturbing the other two units. The operator had received some training on the SkyTrak 6036 Telehandler but had never loaded or unloaded units of this type and had never been or evaluated on lifting loads of this type. Employees who operated and worked near the industrial truck were potentially exposed to struck by and crushed by hazards.

Note: The requirements applicable to construction work under this paragraph are identical to those set forth at �1910.178(l) of this chapter. Reference standard 29 CFR 1910.178(l)(6): Certification. The employer did not certify that each operator has been trained and evaluated as required by this paragraph (l). The certification shall include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation: A) On March 23, 2023 and dates prior at the White Buffalo Meadows Construction Site, Nespelem, WA 99155, the employer did not have documented certification of training and evaluation for completed training of an employee operating a powered industrial truck (SkyTrak 6036 Telehandler).
