29 CFR 1910.28(b)(13)(iii)(A): When work was performed 15 feet (4.6 m) or more from the roof edge, the employer did not protect each employee from falling by a guardrail system, safety net system, travel restraint system, or personal fall arrest system or a designated area:  (a) Roof - On or about March 28, 2023, employees required to access the roof to inspect ammonia refrigeration equipment were exposed to a fall hazard of approximately twenty-five (25) feet in that they were not provided fall protection.   Abatement Certification Required.

29 CFR 1910.119(d)(3)(ii): The employer did not document that equipment complies with recognized and generally accepted good engineering practices:   (a) Engine Room - On or about March 28, 2023, the employer did not document that equipment complies with employer's chosen RAGAGEP IIAR 2-2014 - Safe Design of Closed-Circuit Ammonia Refrigeration Systems, Section 5.14.5, when the pipes in the engine room were not labeled. Failure to properly label process equipment can lead to human error when operating or performing maintenance on ammonia refrigeration process equipment, exposing employees to fire, explosion, and toxic release hazards.  (b) Production Plate Freezer/Votator Area - On or about March 28, 2023, the employer did not document that equipment complies with employer's chosen RAGAGEP IIAR 2-2014 RAGAGEP IIAR 2-2014 Standard for Safe Design of Closed-Circuit Ammonia Refrigeration Systems, Section 5.14.5, when isolation valves, pipping for the plate freezers and votators were not labeled. Failure to properly label process equipment can lead to human error when operating or performing maintenance on ammonia refrigeration process equipment, exposing employees to fire, explosion, and toxic release hazards.  (c) Engine Room - On or about March 28, 2023, the employer did not document that equipment complies with the employer's chosen RAGAGEP IIAR 2 -2014 Standard for Safe Design of Closed-Circuit Ammonia Refrigeration Systems, Section 6.2.5, in that the engine room was not constructed such that air could not flow from the engine room to another occupied section of the building due to a hole in the engine room wall. Failure of the ventilation system or fire suppression system in the engine room could expose employees in the electrical and storage rooms to smoke, fire and anhydrous ammonia.  (d) Production Plate Freezer Area - On or about March 28, 2023, the employer did not document that equipment complies with the employer's chosen RAGAGEP IIAR 2-2014 Standard for Safe Design of Closed-Circuit Ammonia Refrigeration Systems, Section 7.2.4,  when piping containing ammonia was not protected from physical damage by vehicle barriers or alternative protection from powered vehicles normally operating in the area..  (e) Engine Room - On or about March 28, 2023, the employer did not document that equipment complies with the employer's chosen RAGAGEP IIAR 2-2014 Standard for Safe Design of Closed-Circuit Ammonia Refrigeration Systems, Section 5.17.1, in that the ammonia containing equipment subject to physical damage from powered vehicles normally operating in the area was not barricaded or provided with a guard.  (f) Engine Room - On or about March 28, 2023, the employer did not document that equipment complies with the employer's chosen RAGAGEP IIAR 2-2014 Standard for Safe Design of Closed-Circuit Ammonia Refrigeration Systems, Section 16.2.2, in that the liquid level indicator was subject to physical damage from powered vehicles normally operating in the area was not barricaded or provided with a guard. 29 CFR  1910.119(e)(3)(v): The process hazard analysis did not address the hazards related to facility siting:   (a) Engine Room - On or about March 28, 2023, the employer failed to evaluate and control facility siting hazards in that the December 15 & 20, 2021 process hazard analysis did not evaluate and control the hazards of anhydrous ammonia entering the electrical room via a hole in the engine room wall. Failure to control the ingress of anhydrous ammonia could expose workers to inhalation hazards, respiratory illness, and death at high concentrations.  (b) Engine Room - On or about March 28, 2023, the employer failed to evaluate and control facility siting hazards in that the December 15 & 20, 2021 process hazard analysis did not evaluate and control the hazards of vehicle traffic (i.e. a scissor lift) inside the engine room and the struck-by hazards they pose to ammonia refrigeration equipment. Failure to control vehicle traffic around ammonia refrigeration equipment could expose workers to inhalation hazards, respiratory illness, and death at high concentrations.  (c) Engine Room - On or about March 28, 2023, the employer failed to evaluate and control facility siting hazards in that the December 15 & 20, 2021 process hazard analysis did not evaluate and control the hazards of level gauges located in an area such that they could be struck by material handling equipment (i.e. a scissor lift). Failure to place level gauges in a location where they would not be exposed to vehicle traffic could expose workers to inhalation hazards, respiratory illness, and death at high concentrations.  Abatement Certification Required.
