29 CFR 1926.28(a): The employer did not require the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions:  a) On or about March 29, 2023, and at times prior thereto, employees performed framing activities which required the use of power tools such as but not limited to pneumatic nail guns and/or skill saws without eye protection.  b) On or about March 29, 2023, and at times prior thereto, employees involved in framing activities and exposed to overhead hazards were not required to don a protective helmet.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  (a) On or before March 29, 2023, employer did not protect employees from injury in that framers working and standing on the top plate on the first level while constructing a gable roof and were not wearing fall protection and/or using other approved fall protection devices.  This condition exposed employees to fall hazards of approximately 10 feet.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  (a) On or about March 29, 2023, and at times prior thereto, the employer did not protect employees involved in framing activities accessing the top plate from an extension ladder that extended approximately 1-foot over the top plate.  This condition exposed employees to fall hazards of 10-foot fall hazard.

29 CFR  1926.602(d): The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l):  a) On or about March 29, 2023, and at times prior thereto, an untrained employee operated a GEHL RS8-42 to move building materials. This condition exposed employees to struck-by and falling object hazards.
