29 CFR 1926.501(b)(15): Each employee on a walking/working surface 6 feet (1.8 meters) or more above lower levels was not protected from falling by a guardrail system, safety net system, or personal fall arrest system: (a) On or before March 30, 2023, the controlling employer did not ensure subcontractor employees were protected from injury in that two subcontractor employees performing plumbing work at the bottom of a concrete basement foundation were exposed to fall hazards while walking around the perimeter of the foundation, which was about 24 inches above ground level, as well as accessing the foundation near the front of the property. This condition exposed subcontractor employees to fall hazards of approximately 10 feet.

29 CFR 1926.701(b): All protruding reinforcing steel, onto and/or into which employees could fall or come against, was not guarded to eliminate the hazard of impalement: (a) On or before March 30, 2023, the controlling employer did not ensure subcontractor employees were protected from injury in that two subcontractor employees worked and walked around the perimeter of a concrete basement foundation that had un-capped/exposed vertical rebar sticking out from the top. This condition exposed subcontractor employees to impalement hazards.
