OSH ACT of 1970 Section (5)(a)(1): he employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards:   a) Sustainable Hydroponics and Organic Garden Supply, 1424 Enterprise Ct, Rifle, CO: On or about March 30, 2023, and at times preceding, employees were exposed to a struck by hazards while working in and around storage racks that did not display a plaque designating load sizes.

29 CFR  1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance was not being conducted at least once every three years.  a) Sustainable Hydroponics & Organic Garden Supply, 1424 Enterprise Ct, Rifle, CO: On or about March 30, 2023, and at times preceding,  employees were exposed to crushing and struck-by hazards as a result of employees operating powered industrial trucks without undergoing forklift recertification at least once every 3 years.
