29 CFR  1903.19(d)(1):The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  The employer did not provide abatement documentation within 10 days of the abatement date of October 23, 2023, for the following item: Citation 1 Item 1  Citation 1 Item 1: Where mobile test vans were used to meet the audiometric testing obligation, the employer did not obtain a valid baseline audiogram within 1 year of an employee's first exposure at or above the action level:  On or about, June 1, 2023 in the fabrication shop at Almeida Granite at 127 West Rodney French Blvd., New Bedford, MA,  an employee was exposed to an 8-hour time weighted average noise level of 92.4 dBA (equivalently a dose of 140.7%) in excess of the 85 dBA action level (equivalently a dose of 50%) while cutting, grinding, and polishing stone counter tops where annual audiograms from employees were not obtained within a year after the employees first exposure.

29 CFR  1910.95(g)(5)(ii): Where mobile test vans were used to meet the audiometric testing obligation, the employer did not obtain a valid baseline audiogram within 1 year of an employee's first exposure at or above the action level:  On or about, June 1, 2023 in the fabrication shop at Almeida Granite at 127 West Rodney French Blvd., New Bedford, MA,  an employee was exposed to an 8-hour time weighted average noise level of 92.4 dBA (equivalently a dose of 140.7%) in excess of the 85 dBA action level (equivalently a dose of 50%) while cutting, grinding, and polishing stone counter tops where annual audiograms from employees were not obtained within a year after the employees first exposure.  Almeida Marble and Granite LLC was previously cited for a violation of 1910.95(c)(1) which outlined the need for baseline and annual audiograms in a hearing conservation program. This citation was contained in OSHA inspection number 1327713, citation number 1, item number 1 and was affirmed as a final order on 12/03/2018, with respect to a workplace located at 1 Thatcher Street, New Bedford, MA 02744, United States of America.
