29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. On or about April 5, 2023, and at times prior thereto, at a worksite located at Lot 1-4R Block 1 Crowley, Texas, where a competent person was not performing continuous inspections of a trench approximately 13 feet in depth and adjacent to residential homes, traffic and underground utilities where possible cave-ins or indications of failure of protective systems was apparent. Employees were exposed to cave-in hazards.

29 CFR 1926.652(b): The slopes and configurations of sloping and benching systems were not in accordance with the requirement options of 29 CFR 1926.652(b)(1), (b)(2), (b)(3), or (b)(4): On or about April 5, 2023 and at times prior thereto, at or near a worksite located at Lot 1-4R Block 1 Crowley, Texas, where employees were installing water drainage with large diameter re-enforced concrete culverts in a trench deeper than 5 feet with improper benching and exposed to engulfment hazards.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: On or about April 5, 2023 located at Lot 1-4R Block 1 Crowley, Texas and at times prior thereto, while employees were working in the trench that was approximately 13 feet deep and approximately 75 feet long, they were exposed to trench collapse and engulfment due to the egress being further than 25 feet from where employees were working. Exposing them to crush by and engulfment hazards.
