29 CFR  1926.651(c)(2):A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:  On or about April 7, 2023 the employer did not ensure that means of egress were located in a trench excavation in which an employee was working. An employee was hand digging within an excavation of approximately 6 feet.

On or about April 7, 2023 the employer did not ensure that excavated materials including soil was located more than 2 feet from the excavation in which an employee was working within.

29 CFR  1926.651(k)(1):An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift:  On or about April 7, 2023 the employer did not ensure that an excavation in which employees would be working in was inspected throughout the shift. Employees hand dug an excavation to locate a storm sewer tie in. The employer did not inspect the excavation as it grew larger in depth requiring cave in protection.

29 CFR  1926.652(a)(1):Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c).  On or about April 7, 2023 the employer did not ensure that cave in protection was provided to an employee working inside an excavation of approximately 6 feet. An employee was working inside the excavation continually hand digging.
