29 CFR  1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.  On or about 04/04/2023, the employer did not ensure that spoil piles were kept at least two (2) feet from the edge of the trench excavation.   The spoil pile was right at the edge of the vertical wall, in a trench that was approximately twelve (12) feet in depth, approximately three (3) feet wide, approximately six (6) feet in length.

On or about 04/04/2023, the employer failed to remove employees from a hazardous conditions when they were working in a trench with no cave-in protection.  Employees were working in a trench approximately twelve (12) feet in depth, approximately three (3) feet wide, approximately six (6) feet in length.
