29 CFR  1926.20(b)(4): The employer failed to permit only those employees qualified by training to operate equipment and machinery:  a) At the worksite, 66 Glenwood Avenue, Binghamton, NY 13905.  On or about April 7, 2023, an employee was operating a John Deere Dozer (T0650JX103481). The employer failed to provide the operator with initial training regarding operating instructions, warnings, and precautions for the types of trucks the operators were authorized to operate.  An employee was run over by the bulldozer and suffered serious injuries.

29 CFR  1926.602(a)(9)(ii): Earth moving or compacting equipment which had an obstructed view to the rear was operated in reverse gear; such equipment did not have in operation a reverse signal alarm distinguishable from the surrounding noise level or did an employee signalled that it is safe to do so.  a)  At the worksite, 66 Glenwood Avenue, Binghamton, NY 13905.  On or about April 7, 2023, an employee was operating a John Deere Dozer (T0650JX103481). The reverse signalling alarm was not audible above the surrounding noise level.  The employer failed to have an employee signalling that it was safe to reverse.  An employee was run over by the equipment and suffered serious injuries.
