29 CFR  1926.102(a)(1):  The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a.  On or about April 12, 2023, at the above addressed jobsite, an employee using a pneumatic nail gun did not wear safety glasses, thereby exposing the employee to struck-by hazards associated with flying objects into eyes.

29 CFR 1926.501(b)(13):  Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a.  On or about April 12, 2023, at the above addressed jobsite, employees performing residential carpentry operations twenty (20') feet above the ground, were not protected from falling, thereby exposing employees to fall hazards.  b.  On or about April 12, 2023, at the above addressed jobsite, employees performing residential carpentry operations on or near balcony windows, fourteen (14') feet above the ground, were not protected from falling, due to guardrail system not containing a midrail.   Employees were thereby exposed to fall hazards.

29 CFR 1926.503(b)(1):  The employer did not verify compliance with paragraph (a) of this section by preparing a written (training) certification record including the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer.  a.  On or about April 12, 2023, at the above addressed jobsite, employees had been provided fall protection training, however, the employer failed to keep a written certification of the training.
