29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface were not used. On or about April 13, 2023, Winner Worx did not provide adequate means of access to a ladder jack scaffold platform that was approximately 16' above a point of access in a worksite located at 2812 Salena Street in Saint Louis, Missouri.

On or about April 13, 2023, Winner Worx did not identify and withdraw a portable extension ladder with broken rungs from service. The ladder's first and fifth rungs were broken and it was utilized as part of a ladder jack scaffold as well as used to access the scaffold's working surface in a worksite located at 2812 Salena Street in Saint Louis, Missouri.
