29 CFR  1926.651(h)(1):Employees were working in excavations in which there was accumulated water, or excavations in which water was accumulating, and adequate precautions had not been taken to protect employees against the hazards posed by water accumulation.  On or about April 13, 2023, employees were exposed to a cave in hazard while performing sewer line replacement at a residential home located at 277 Beck Ave., Akron, Ohio 44312.  An employee was working in a 7 foot 4 inch deep trench that had accumulated water in it and the employer did not ensure that adequate precautions were taken to remove the water.

29 CFR  1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:  On or about April 13, 2023, employees were exposed to a cave in hazard while performing sewer line replacement at a residential home located at 277 Beck Ave., Akron, Ohio 44312.  An employee was working in a 7 foot 4 inch deep trench and the employer did not ensure there was a safe means of egress.  Downs Drain & Septic Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard (29 CFR 1926.651c(2), which was contained in OSHA inspection number 1587148, citation number 1,  item number 1, and was affirmed as a final order on 5/13/22, with respect to a workplace located at 193 Sand Run, Akron, Ohio 44313.

On or about April 13, 2023, employees were exposed to a cave in hazard while performing sewer line replacement at a residential home located at 277 Beck Ave., Akron, Ohio 44312.  An employee was working in a 7 foot 4 inch deep trench and the employer did not ensure cave in protection was used.  Downs Drain & Septic Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard (29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 1587148, citation number 1,  item number 3, and was affirmed as a final order on 5/13/22, with respect to a workplace located at 193 Sand Run, Akron, Ohio 44313.
