29 CFR 1910.37(a)(3): Exit routes must be free and unobstructed. No materials or equipment may be placed, either permanently or temporarily, within the exit route. The exit access must not go through a room that can be locked, such as a bathroom, to reach an exit or exit discharge, nor may it lead into a dead-end corridor. Stairs or a ramp must be provided where the exit route is not substantially level.  a. On or about April 17, 2023, and at times prior, the emergency exit in the back of the warehouse near the Cleaning Area was not accessible due to being blocked by storage of materials. Employees were thereby exposed to the hazards associated with emergency evacuation such as, but not limited to, burns, smoke inhalation, caught-between and crushing injuries.

29 CFR 1910.178(a)(5): If the truck is equipped with front-end attachments other than factory installed attachments, the user shall request that the truck be marked to identify the attachments and show the approximate weight of the truck and attachment combination at maximum elevation with load laterally centered.  a. On or about April 13, 2023, and at times prior, a Vestil Manufacturing Company front-end attachment man-basket (Model: WP-3636, Weight: 200 lbs.) was in use on a CAT battery-operated forklift (Model: ND3000; Serial No: 2ND3617711; 5882 lbs. with 2300 lbs. battery) without markings identifying the attachment and the combined weight. Employees were thereby exposed to struck-by hazards.

Safety of equipment shall be determined using the following considerations:  29 CFR 1910.303(b)(1)(v): Heating effects under all conditions of use;  a. On or about April 17, 2023, and at times prior, the employer did not ensure that the Tripp-Lite 8-outlet relocatable power tap (power strip) in use in the back of the building in the Catch-All Storage Area, was free from heating effects under all conditions of use. The energized relocatable power tap was daisy-chained to an extension cord with numerous extension cords and power tools and electronics plugged into it. Employees were thereby exposed to fire and contact with electrical hazards.

On or about April 17, 2023, and at times prior, in the back of the building, along the rear wall of the emergency exit near the overhead door, in the Cleaning/Prepping Area, the employer did not ensure that a Tripp-Lite 8-outlet relocatable power tap (power strip) was installed and utilized in accordance with the listing and labeling instructions (UL1363) in that it was in use in a work area along the back wall spliced into an extension cord and not plugged directly into an outlet. Employees were thereby exposed to fire and contact with electrical hazards.  b. On or about April 17, 2023, and at times prior, in the back of the building in the Catch-All Storage Area, the employer did not ensure that a Tripp-Lite 8-outlet relocatable power tap (power strip) was installed and utilized in accordance with the listing and labeling instructions (UL1363) in that it was in use in a work area along the back wall powered by an extension cord and not plugged directly into an outlet. On or about April 17, 2023, and at times prior, in the back of the building next to the emergency exit, a portable fire extinguisher was not readily accessible in that it was blocked by storage of materials.   b. On or about April 17, 2023, and at times prior, in the front of the building on an upright for Aisle 4, a portable fire extinguisher was not mounted in the denoted and marked area.  c. On or about April 17, 2023, and at times prior, by the front door of the building, a portable fire extinguisher was not identified by signage.
