OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to caught under and/or struck-by hazard.  Location: a) At 57 Ann Street, New York, NY 10038:  On or about April 18, 2023, an employee removed brick from a structural column of a building in an attempt to prevent brick from falling, without shoring or bracing the column. During this process, additional bricks fell from the column. Employees were exposed to caught under, crushed-by, and struck-by hazards when the building partially collapsed.  Abatement Note: At the 57 Ann Street location,  (a) Should the Garage at 57 Ann Street be re-built and should the Respondent resume business at the 57 Ann Street location, among other methods, one feasible and acceptable method to correct any hazards is to have a competent person conduct inspections as the work progresses to detect any potential or actual hazards. Furthermore, should 57 Ann Street resume its parking garage business at the 57 Ann Street location, no worker shall be permitted to work where such hazards exist until the hazards are corrected by shoring, bracing or other effective means. Access controls shall be established to prevent unauthorized entry into the work zone.
