29 CFR 1918.94(a)(1): When internal combustion engines exhausted into a hold, intermediate deck, or other compartment, the employer did not ensure that the atmosphere was tested as frequently as was needed to prevent carbon monoxide (CO) concentrations from exceeding allowable limits: a. On or about 3 March 2023, at Panamerican Dock II, San Juan, PR. Employer did not test carbon monoxide (CO) concentrations when employees engaged in marine terminal tasks such as, but not limited to: RO/RO (roll-on/roll-off) operations, driving and unlashing cargo for the vehicles inside of the M/V HEOGH OSAKA vessel. b. On or about 19 April 2023, at Panamerican Dock II, San Juan, PR. Employer did not test the carbon monoxide (CO) concentrations when employees engaged in marine terminal tasks such as, but not limited to: RO/RO (roll-on/roll-off) operations, driving and unlashing cargo for the vehicles inside of the M/V HEOGH OSAKA vessel. NOTE: Certification and documentation of abatement must be submitted for this citation item as required by 29 CFR 1903.19(c).

Employer did not report within 8 hours, the death of an employee who collapsed while unlashing cargo for vehicles from inside the M/V HEOGH OSAKA vessel and later died at the hospital. OSHA became aware of this fatality on 18 April 2023. NOTE: Certification of abatement is not required for this citation item as abatement was documented by the compliance safety and health officer during the inspection.
