29 CFR  1910.178(l)(6): The employer did not certify that each operator has been trained and evaluated as required by this paragraph (l):  a) On or about April 20, 2023, Trader Joes East Inc. did not certify that each employee required to use a Yale Lift Truck (Big Joe) was trained and evaluated as required by this paragraph.   Trader Joe's East Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA Inspection Number 1551751, Citation Number 2, Item Number 1 and was affirmed as a final order on October 18, 2021, with respect to a workplace located at 44 Thompson Place in Boston, MA 02210.  Trader Joe's East Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA Inspection Number 1449648, Citation Number 2, Item Number 1 and was affirmed as a final order on March 20, 2020, with respect to a workplace located at 350 Patriot Place, Foxborough, MA. 02210.  No abatement certification or documentation is required for this item.

29 CFR  1910.178(q)(7): Industrial trucks were not examined before being placed in service:  a) On or about April 20, 2023, Trader Joes East Inc. did not to ensure that all powered industrial vehicles, such as the Yale Lift Truck (Big Joe), were examined before being placed into service.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
