29 CFR  1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  a) At the worksite, 22122 Freedom Drive, Champion NY -  In the eastern side yard. On or about 4/20/2023, employees were in and around an open trench, approximately 6-7 feet deep, installing 4" drainage pipe and were not instructed on recognizing and avoiding the hazards associated with working in and around an open trench.

29 CFR  1926.651(k)(1):Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions.  a) At the worksite, 22122 Freedom Drive, Champion NY -  In the eastern side yard. On or about 4/20/2023, a 6-7 foot trench was being dug for the installation of a 4 inch daylight footer drain. The trench was not evaluated by a competent person, as needed, resulting in a trench collapse.

29 CFR  1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:  a) At the worksite, 22122 Freedom Drive, Champion NY -  In the eastern side yard. On or about 4/20/2023, employees were in an open trench, approximately 6-7 feet deep, installing 4" drainage pipe and a stairway, ladder, ramp or other means of egress was not within 25 feet of travel. At the time of the incident employees were 29 feet from the southeast corner of the house and 50 feet from an access.

On or about 4/20/2023,  an open trench, approximately 6-7 feet deep, was being dug for the installation of a 4 inch daylight footer drain. The excavated material was placed within 2 feet of the edge of the trench exposing employees to the hazard of falling material.

On or about 4/20/2023, a 6-7 foot trench was being dug for the installation of a 4 inch daylight footer drain. Employees in the trench were not protected from a cave-in by an adequate protective system exposing the employees to a trench collapse resulting in an employee fatality.
