29 CFR 1926.20(b) Accident prevention responsibilities. (2):Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. a) On April 26, 2023, the employer failed to ensure adequate frequent and regular inspections of the job site. As a result, employees performing roofing activities were observed working atop an A-frame ladder, exposed to a 6' fall hazard, and another employee was observed working on top of the building without a fall protection system, exposed to a 10'5" fall hazard.

Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems. a) On April 26, 2023, the employer did not ensure the use of a fall protection system for an employee who was exposed to a fall hazard of at least 10'5" while performing work on a steep metal roof with a pitch of 10/12.

The following requirements apply to the use of all ladders, including job-made ladders, except as otherwise indicated: (13):The top or top step of a stepladder shall not be used as a step. a) On April 26, 2023, the employer failed to ensure that employees working from a step ladder, did so correctly in that an employee was using the top step as a working position while assisting with roofing work on a steep-pitch metal roof. As a result, the employee was exposed to a fall hazard of 6 feet.
