29 CFR  1903.19(c)(1):The employer did not certify to OSHA, within 10 calendar days after the abatement date, that the cited violation had been abated:  (a) Ju Ju's Roofing, failed to certify abatement within 10 calendar days after the abatement date that each of the following cited violations had been corrected:   Citation 1, Item 1 a serious violation of 29 CFR 1926.20(b)(2) with an abatement date of July 20, 2023.  Citation 1, Item 3a a serious violation of 29 CFR 1926.501(b)(13) with an abatement date of July 13, 2023.  Citation 1, Item 3b a serious violation of 29 CFR 1926.503(a)(1) with an abatement date of July 27, 2023.  Citation 1, Item 4 a serious violation of 29 CFR 1926.1053(b)(1) with an abatement date of July 13, 2023.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATIONS OF THE CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.20(b)(2): The employer did not initiate and maintain frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s):  (a)  On or about April 27, 2023, a competent person was on site but did not perform frequent and regular inspections of the job site to ensure that hazardous conditions were identified and corrected. Employees were exposed to fall hazards of over twenty-five (25) feet from not implementing fall protection while working from the roof and  from improperly installed ladders for accessing the roof. Employees were exposed to struck-by hazards when not using a hard hat while working below the roofers.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system.   (a) On or about April 27, 2023, employees conducting roofing activities (shingle installation) on a second story  6:12 pitch roof were not protected from falling to the lower level. This exposed employees to a fall hazard of approximately 25 feet on the North and South sides of structure onto concrete and dirt.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:  (a) On or about April 27, 2023, the portable extension ladder being used to access the upper landing area on the roof of the structure near the chimney did not extend at least three feet above the upper landing area. This exposed employees accessing and egressing to and from the roof, to a fall hazard of approximately 25 feet.  (b) On or about April 27, 2023, the portable extension ladders being used to access the upper landing area on the roof of the structure on the southside  or back of the house did not extend at least three feet above the upper landing area. This exposed employee(s) accessing and egressing to and from the roof to a fall hazard of approximately 25 feet.
