29 CFR 1926.20(b)(2): The employer did not initiate and maintain frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s): (a) On or about April 27, 2023, a competent person was on site but did not perform frequent and regular inspections of the job site to ensure that hazardous conditions were identified and corrected. Employees were exposed to fall hazards from not implementing fall protection while working from the roof and not implementing fall protection while working from the aerial lift, and not ensuring that extension ladders were erected to three (3 ) feet above the landing surface or secured to the structure and a hand grab installed.

29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: Note: As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e). (a) On or about April 27, 2023, a safety harness with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift. The aerial lift was being used to transport employees to and from the roof of the structure where gutters were being installed. This exposed employees to an ejection hazard, as well as a fall hazard of approximately 30 feet.

This exposed employees accessing and egressing the roof, to a fall hazard of approximately eight (8) feet onto the third floor balcony, and a fall a hazard of 28 feet to the ground below if the employee fell over the guard rail of the balcony.
