Alleged Violation Description OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck-by hazards associated with inadequately maintained racking systems:  (a)East Coast Warehouse & Fulfillment located at 252 Welsh Pool Road Exton, PA-Throughout the warehouse: On or about May 4, 2023, employees operating forklifts  to load and unload merchandise from  damaged steel racking system with bent upright columns. The racking system was used to store pallets with cardboard boxes exposing employees working near the damage racks to falling objects and rack collapses.

29 CFR  1910.37(a)(3): Exit route(s) were not kept free and unobstructed:   (a) East Coast Warehouse & Fulfillment located at 252 Welsh Pool Road Exton, PA- Warehouse (Rack A):  On or about May 4, 2023, the employer did not ensure that the exit route was maintained free of obstructions. A  wooden pallet filled with product in cardboard boxes was placed and stored within the emergency exit route, exposing employees to fire hazards in case of an emergency.

29 CFR  1910.178(l)(4)(iii):An evaluation of each powered industrial truck operator's performance was not being conducted at least once every three years:  (a) East Coast Warehouse & Fulfillment located at 252 Welsh Pool Road Exton, PA- Warehouse: On or about May 4, 2023, the employer did not ensure that an employee operating powered trucks such as, but not limited to, Raymond 8410 End Rider Pallet Truck and Raymond 700 Series Reach-Fork Trucks, received an evaluation of the operator's performance once every three years.
