29 CFR 1910.134(c)(1): In any workplace where respirators are necessary to protect the health of the employee or whenever respirators are required by the employer, the employer did not establish and implement a written respiratory protection program with worksite-specific procedures:  a.  On or about 25 April 2023, at the maintenance repair shop. The employer did not develop a written respiratory protection program to address procedures on the use of NIOSH approved half-face respirators (3M Cool flow) provided and required to be worn by auto body repairer and painter during heavy equipment painting jobs.   b.  On or about 25 April 2023, at the cement hopper area. The employer did not develop a written respiratory protection program to address procedures on the use of NIOSH approved half-face respirators required to be worn and not provided to forklift operator during 3,200 lbs Portland cement bags loading and bursting operation.  NOTE:   Certification of abatement must be submitted for this citation item as required by 29 CFR 1903.19(c).

On or about 25 April 2023, at the cement hopper, staging areas and repair shop, at Chitolie Concrete Products, St. Croix, VI.  Employees were wearing tennis shoes and other types of shoes that do not meet the specifications of ANSI Z41.1-1967.  Note:  Certification of abatement is not required for this citation item as abatement was documented by the compliance safety and health officer within 24 hours of the inspection.
