29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system.  Employees were engaged in waterproofing activities at a new construction residential building located on the corner of King St. and Reynolds St. (The house had not been assigned a street number at the time of the inspection), and were exposed to fall hazards in that the employee was working on working surfaces that were greater than six feet, without means to mitigate the hazard.

1926.20(b)(2)  Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.  The employer failed to conduct frequent and regular inspections of the job site located on the corner of King St. and Reynolds St. *the house had not been assigned a street number at the time of the inspection), where employees were engaged in waterproofing activities of a new construction residential building, to identify hazardous working conditions, including potential uncovered impalement hazards from protruding objects.
