29 CFR  1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user:  At a worksite located at 2857 U.S. HWY 40, Blue Springs, MO 64015:   The employer failed to protect employees from respiratory hazards; including but not limited to dermatitis, asthma, heart condition, allergic respiratory effects, claustrophobia, and mucosal and nonallergic respiratory effects. This was most recently demonstrated on or about May 4, 2023, and at times prior to, when employees wore tight-fitting elastomeric respirators and the employer had not established and implemented elements of a written program necessary such as medical evaluations.

29 CFR  1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  At a worksite located at 2857 U.S. HWY 40, Blue Springs, MO 64015:   The employer failed to protect employees from exposure to toxic and/or hazardous substances associated with the manufacturing of consumable health supplements. This was most recently demonstrated on or about May 4, 2023, and at times prior to when employees were exposed to various substances, including but not limited to High Calcium Hydrated Lime, D-Limonene, and Glycerin (Glycerol), Food Grade. The employer had not developed or implemented a written hazard communication program.

29 CFR  1910.132(d)(2): The employer did not verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated, the person certifying that the evaluation has been performed, the date(s) of the hazard assessment, and, which identifies the document as a certification of hazard assessment:  At a worksite located at 2857 U.S. HWY 40, Blue Springs, MO 64015:   The employer failed to protect employees from both physical and health hazards associated with the production of stone at the facility including but not limited to the manufacturing of facade stone products through a written hazard assessment. This was most recently demonstrated on or about May 4, 2023, and at times before when employees in the production area were exposed to physical and health hazards; including but not limited to, toxic or hazardous substances.
