29 CFR 1910.134(c)(2):  The employer did not develop and implement a respiratory protection program in accordance with sections (i) and (ii) of this paragraph (c)(2) for employees who chose to wear respirators where respirator use was not required:  a) 60 Filbert Street, Hanover, PA 17331 - On or about June 29, 2023, employees were observed wearing half-mask, elastomeric respirators on a voluntary basis during RIM Clamp operations and sanding operations and the employer did not develop and implement a respiratory protection program that outlined the voluntary use of respirators.  b) 60 Filbert Street, Hanover, PA 17331 - On or about June 29, 2023, employees were observed wearing half-mask, elastomeric respirators on a voluntary basis during RIM Clamp operations and sanding operations, and did not participate in medical evaluations.    Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.134(k)(6): The employer did not provide the basic advisory information on respirators, as presented in Appendix D of 29 CFR 1910.134, in written or oral format to employees who wear respirators when such use was not required by the employer:  a) 60 Filbert Street, Hanover, PA 17331 - On or about June 29, 2023, employees were observed wearing half-mask, elastomeric respirators on a voluntary basis during RIM Clamp operations and sanding operations, and the employer did not provide the basic advisory information on respirators, as presented in Appendix D of 29 CFR 1910.134, in written or oral format to employees who wear respirators on a voluntary basis. 29 CFR 1910.1200(h)(3)(ii):  Employee training did not include the physical and health hazards of the chemicals in the work area:  a) 60 Filbert Street, Hanover, PA 17331, Reaction Injection Molding (RIM) Clamp Area - On or about May 9, 2023, employees were utilizing chemicals including, but not limited to, Telene Part A and Part B, which contained dicyclopentadiene.  Employees did not have training on the chemical and physical hazards of the dicyclopentadiene, nor were the employees informed and trained of the dicyclopentadiene content within these chemicals.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
