29 CFR 1910.146(c)(4): If the employer decides that its employees will enter permit spaces, the employer shall develop and implement a written permit space program that complies with this section. The written program shall be available for inspection by employees and their authorized representatives. a. On or about May 9, 2023, in the facility, employees were required to enter permit required confined spaces when conducting tank cleaning operations. Employees were exposed to the hazards associated with permit required confined spaces when the employer failed to develop a comprehensive written permit space program which included the following: (d)(2): identify and evaluate hazards of permit space(s) prior to entry; (d)(3): means, procedures and practices necessary for safety permit space entry operations; and (d)(14): Review of the permit space entry program annually.

29 CFR 1910.146(f): The entry permit that documents compliance with this section and authorizes entry did not identify the required information listed in (f)(1)-(f)(15): a. On or about April 24, 2023, in the facility, employees were required to enter permit required confined spaces to perform cleaning operations. Employees were exposed to hazards associated with permit required confined spaces when the entry permit designed to document compliance did not include: (f)(6); the name of the entry supervisor and an allotted signature notation; (f)(8): The measures used to isolate and eliminate or control hazards; (f)(9): Acceptable entry procedures; (f)(12): Communication methods; and (f)(13): Necessary equipment (personal protective equipment, testing, rescue) to be provided with entry.
