OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. a) On or about May 10, 2023, the employer did not ensure a safe and hazard-free work environment in that an employee was riding in the bucket of a Caterpillar 239D3 Compact Track Loader skid steer traveling westbound on an urban roadway to perform landscaping work on a residential home exposing the employee to potential fall and struck-by hazards in the event they were to fall out of the bucket.

29 CFR 1926.21(b)(2):The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. a) On or about May 10, 2023, the employer failed to provide adequate instruction to employees regarding the recognition and avoidance of hazards associated with operating a Skid-Steer Loader, as a result, an employee was exposed to a struck-by and fall hazard while riding in the bucket of a Caterpillar 239D3 Compact Track Loader skid steer traveling on an urban roadway.
