29 CFR  1926.452(w)(6)(i): Employee(s) were allowed to ride on scaffolds when the surface on which the scaffold was moved was not within 3 degrees of level, and/or not free of pits, holes, and obstructions:    a) Worksite, 11 Union Ave., Bethpage, NY- Employee was operating a JLG Scissor lift Model 2632ES on unstable ground which was not free of pits and holes; on or about 5/11/23.  Note:  In addition to abatement certification the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.

29 CFR  1926.454(a):The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.  a) Worksite, 11 Union Ave., Bethpage, NY- Employee was not trained to recognize hazards associated with operating a JLG Scissor lift Model 2632ES onto unstable ground conditions inadequate to support the weight of the extended lift; on or about 5/11/23.  Note:  In addition to abatement certification the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.
