29 CFR 1910.151(c): Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use:  On or about 05/17/2023, at 89210 Overseas Highway, Tavernier, FL 33070, the employer did not ensure that a suitable facility for quick drenching or flushing of the eyes and body was provided for employees exposed to corrosive chemicals including, but not limited to, 12.5% sodium hypochlorite (with a pH of 11.2-11.4), exposing them to eye and skin burns.

29 CFR  1910.1200(e)(1): The employer did not develop, implement and maintain at the workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g) and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met:  On or about 05/17/2023, at 89210 Overseas Highway, Tavernier, FL 33070, the employer did not develop, implement, and maintain at the workplace a written hazard communication program where employees were exposed to corrosive chemicals including, but not limited to, 12.5% sodium hypochlorite, 31.5% hydrochloric acid, and 99% trichloro-s-triazinetrione while handling swimming pool chemicals.

29 CFR 1910.1200(g)(8): The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical, and did not ensure that they were readily accessible during each work shift to employees when they were in their work area(s):  On or about 05/17/2023, at 89210 Overseas Highway, Tavernier, FL 33070, the employer failed to ensure effective measures for communication about hazardous chemical information to employees due to not maintaining copies of safety data sheets for every hazardous chemical in the workplace including, but not limited to, Lo-Chlor FastStart-Tech, Lo-Chlor Ultra Zyme Pro, and Lo-Chlor Miraclear Blue and not ensuring all safety data sheets were readily accessible to employees.
