29 CFR 1926.451(g)(1)(i): Each employee on a boatswains' chair, catenary scaffold, float scaffold, needle beam scaffold, or ladder jack scaffold was not protected by a personal fall arrest system: a. On or about May 23, 2023, at the above addressed jobsite, an employee performing residential fascia installation operations from a ladder jack scaffold, twelve (12) feet eleven (11) inches above ground, was not protected from falls, thereby exposing the employee to fall hazards. b. On or about May 23, 2023, at the above addressed jobsite, an employee performing residential fascia installation operations from a ladder jack scaffold, fourteen (14) feet seven (7) inches above ground, was not protected from falls, thereby exposing the employee to fall hazards.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. a. On or about May 23, 2023, at the above addressed jobsite, an employee was not provided with a safe means of access to and egress from a ladder jack scaffold being used at an elevation of twelve (12) feet eleven (11) inches above ground. b. On or about May 23, 2023, at the above addressed jobsite, an employee was not provided with a safe means of access to and egress from a ladder jack scaffold being used at an elevation of fourteen (14) feet seven (7) inches above ground.
