29 CFR  1926.20(b)(2): Accident prevention responsibilities. Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.  a) On May 11, 2023, the employer failed to ensure frequent and regular inspections of the jobsite were conducted. As a result, employees were exposed to a fall hazard of 9 feet 8 inches due to: (1) Too many lanyards connected to the lifeline, which would allow employees to contact the blacktop before the fall arrested; (2) The lifeline that employees were attached to was too long, failing to prevent a 6-foot fall to the blacktop; and (3) Employees were trained in the recognition and avoidance of fall hazards.

29 CFR  1926.502(d)(8):Horizontal lifelines shall be designed, installed, and used, under the supervision of a qualified person, as part of a complete personal fall arrest system, which maintains a safety factor of at least two.  a) On May 11, 2023, the employer failed to ensure that the horizontal lifeline, used by two employees, was designed, installed, and supervised by a qualified person as part of a complete personal fall arrest system. As a result, employees were exposed to a fall hazard of 9 feet 8 inches from an improperly installed and utilized lifeline.

29 CFR  1926.502(d)(16): Personal fall arrest systems, when stopping a fall, shall:     (iii): be rigged such that an employee can neither free fall more than 6 feet (1.8 m), nor contact any lower level;  a) On May 11, 2023, the employer failed to ensure that the personal fall arrest system in use was rigged to prevent employees from free-falling more than 6 feet or contacting any lower level. As a result, employees working on a commercial roof were exposed to a fall hazard of 9 feet 8 inches in that the fall protection system in place would not have prevented the employees from contacting the ground.

29 CFR  1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.   a)	On or about May 11, 2023, The employer did not ensure that employees were trained in the recognition and avoidance of fall hazards as a result, employees working from a commercial roof were using a protection system that was incorrectly set up as it would not have properly activated to prevent employees from falling greater than 6' and contacting the ground.
