29 CFR 1926.451(e)(1): When scaffold platforms are more than 2 feet above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall be used. Crossbraces shall not be used as a means of access: a) Jobsite at 607 East Market Street, West Chester, PA 19380 - On or about May 23, 2023, the employer did not ensure employees used approved point of access to gain access to the scaffold. Employees utilized the scaffold supports to access the roof, thereby exposing employees to fall hazards of approximately 13 feet.

29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section: a) Jobsite at 607 East Market Street, West Chester, PA 19380 - On or about May 23, 2023, the employer failed to ensure that employees performing stucco installation on a commercial building were protected from falls by the use of a fall protection system. Employees worked on a roof bracket scaffold to install stucco to the side of the building without fall protection, thereby exposing employees to falls of approximately 13 feet.
