29 CFR  1910.95(c)(1):The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  Warehouse: On or about July 31, 2023, and times prior thereto, employees were exposed to noise hazards due to the employer failing to develop and administer a hearing conservation program.  (a) Warehouse area: An employee sorting and packing the steel plate together for shipping was exposed to continuous noise levels at 99.7 % of the permissible 8-hour time-weighted average (TWA). The equivalent decibel (dBA) level of 99.7 % is approximately 89.9 dBA.  Sampling was performed for 460 minutes during one shift, not including the lunch break.   (b) Warehouse area: An employee operating the Piranha hydraulically powered shearing machine was exposed to continuous noise levels at 121.7 % of the permissible 8-hour time-weighted average (TWA). The equivalent decibel (dBA) level of 121.7 % is approximately 91.4 dBA.  Sampling was performed for 465 minutes during one shift, not including the lunch break.   (c) Warehouse area: An employee operating the Piranha hydraulically powered shearing machine was exposed to continuous noise levels at 108.7 % of the permissible 8-hour time-weighted average (TWA). The equivalent decibel (dBA) level of 108.7  % is approximately 90.6 dBA.  Sampling was performed for 451 minutes during one shift, not including the lunch break.
