Located at that jobsite at 4540 Gender Road, Canal Winchester, Ohio: On or about May 25, 2023, the employer did not instruct and train employees performing trenching work onsite on the recognition of cave-in hazards and the protective systems requirements to prevent cave-in hazards in accordance with 29 CFR 1926 Subpart P.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems shall be made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. An inspection shall be conducted by the competent person prior to the start of work and as needed throughout the shift. Inspections shall also be made after every rainstorm or other hazard increasing occurrence. These inspections are only required when employee exposure can be reasonably anticipated.  a. Located along the east side of 4540 Gender Road, Canal Winchester, Ohio: On or about May 25, 2023, the employer did not ensure that the trench was inspected by a competent person to ensure that an adequate protective system was in place to protect employees from cave-in hazards.   b. Located along the west side of 4540 Gender Road, Canal Winchester, Ohio: On or about May 25, 2023, the employer did not ensure that the trench was inspected by a competent person to ensure that an adequate protective system was in place to protect subcontractor employees from cave-in hazards.

29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section.  a. Located along the east side of 4540 Gender Road, Canal Winchester, Ohio: On or about May 25, 2023, the employer did not ensure that an adequate sloping system was in place prior to employees accessing the trench to perform pipe laying work, thereby exposing the employees to a cave in hazard.  b. Located along the west side of 4540 Gender Road, Canal Winchester, Ohio: On or about May 25, 2023, the employer did not ensure that an adequate sloping system was in place prior to a subcontractor employee accessing the trench to perform a watermain tap connection, thereby exposing the subcontractor employee to a cave in hazard.
