29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury:  (a)Jireh Concrete at 4001 West Valhalla Boulevard, Sioux Falls, SD 57106: On or about May 25, 2023, the employer did not ensure that employees were protected from hazards with the Stihl TS 420 cut-off saw, in that employees were not instructed in the recognition of unsafe operating conditions per manufacturer's instructions to include but not limited to, body positioning, to prevent kickback, struck-by and fire hazards.  This condition exposed employees to struck-by and fire hazards.

29 CFR 1926.1153(c)(1):  For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1:  (a)Jireh Concrete at 4001 West Valhalla Boulevard, Sioux Falls, SD 57106: On or about May 25, 2023, the employer did not ensure that exposure control methods were being implemented as an employee was using a Stihl TS 420 cut-off saw to cut concrete. This condition exposed an employee to respirable crystalline silica with sawing operations.

This condition exposed an employee to respirable crystalline silica with concrete sawing operations.
