29 CFR  1926.453(b)(2)(v): A body belt  shall be worn and a lanyard attached to the boom or basket when working from an aerial lift:  On or about May 24, 2023, the employer did not ensure that the employee using an aerial lift utilized fall protection. An employee using a Nifty SP34 #499 aerial lift  was exposed to fall hazards approximately 16 feet while engaged in residential construction activities.   No abatement certification or documentation is required for this item

29 CFR  1926.454(a)(1):The employer failed to have each employee who performs work while on a scaffold trained regarding the nature of any electrical hazards, fall hazards and falling object hazards in the work area.  On or about May 24, 2023, the employer did not ensure that employees were trained to recognize and minimize hazards associated with falls while operating aerial lifts.  An employee using a Nifty SP34 #499  aerial lift was exposed to fall hazards of approximately 16  feet while performing construction activities without utilizing fall protection.     Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).
