29 CFR  1926.416(a)(1):The employer permitted employees to work in close proximity to energized, unguarded, and ungrounded electric power circuits that the employee could contact in the course of their work:   (a)Evodio Ramon Castaneda at 2305 East Austin Street, Sioux Falls, SD 57103:  On or about and at times prior to May 25, 2023,  the employer did not ensure employees were protected from electrical shock and burn hazards in that employees were allowed to work within approximately 4-feet of energized power lines.  This condition exposed employees to electrical shock, burn, and fall hazards.

29 CFR  1926.416(a)(3): The employer began work without determining if employees could contact any part of an energized circuit and did not post warning signs and advise employees of the location of the circuit, hazards, and protective measures they need to take:  (a)Evodio Ramon Castaneda at 2305 East Austin Street, Sioux Falls, SD  57103:  On or about and at times prior to May 25, 2023,  the employer did not ensure employees were protected from electrical shock and burn hazards in that employees were not informed or warned about the location of the power lines and were allowed to work within approximately four feet of the power lines.  This condition exposed employees to electrical shock and burn hazards.

29 CFR  1926.501(b)(13): Employees engaged in residential construction activities six feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):   (a)Evodio Ramon Castaneda at 2305 East Austin Street, Sioux Falls, SD  57103:  On or about and at times prior to May 25, 2023,  the employer did not ensure employees were protected from falls while conducting roof vent and soffit/facia replacement operations on a residential home. This condition exposed employees to fall hazards greater than six feet.

29 CFR  1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend to at least 3 feet (.9m) above the upper landing surface to which the ladder was used to gain access nor was the ladder secured at it's top to a rigid support and a grasping device, such as a grabrail, provided to assist the employee in mounting and dismounting the the ladder:  (a)Evodio Ramon Castaneda at 2305 East Austin Street, Sioux Falls, SD  57103:  On or about and at times prior to May 25, 2023,  the employer did not ensure employees were protected from fall hazards in that employees were allowed to use a ladder to access an upper landing that did not extend at least three feet above the upper landing surface of the residential roof.  This condition exposed employees to fall hazards.
