29 CFR  1926.1153(c)(1): For each employee engaged in a task identified in Table 1, the employer did not fully and properly implement the engineering controls, and work practices, specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section.  a) On or about June 1, 2023, at Clark and W. Lawrence Avenue, JSL Building Restoration Group, Inc. did not fully and properly implement engineering controls and work practices, as specified in Table 1 when using a Metabo WEV 17-125 angle grinder to grind and tuckpoint concrete containing up to 10% of respirable crystalline silica (Quartz) without equipping the tool with a water delivery system that supplies a continuous stream or spray of water at the point of impact or a tool equipped with a commercially available shroud and dust collection system.  b) On or about June 1, 2023, at Clark and W. Lawrence Avenue, JSL Building Restoration Group, Inc. did not fully and properly implement engineering controls and work practices, as specified in Table 1 when using a Bosch 11318 EVS demolition hammer to tear down concrete containing up to 10% of respirable crystalline silica (Quartz) without equipping the tool with a water delivery system that supplies a continuous stream or spray of water at the point of impact or a tool equipped with a commercially available shroud and dust collection system.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR  1910.134(g)(1)(i)(A): The employer permitted respirators with tight-fitting facepieces to be worn by employees who have facial hair that comes between the sealing surface of the facepiece and the face or that interferes with valve function.  a) On or about June 1,2023, JSL Building Restoration Group, Inc. required that its employees working at St. Boniface Cemetery use respiratory protection to minimize exposures to silica dust when performing demolition and grinding as described in the company silica exposure safety policy & written exposure control plan. An employee using a 3M 6899B full face respirator had facial hair that interfered with the seal between the facepiece and the face.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
