29 CFR  1926.95(a): Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact.    a) Regency Village Apartments , 12-22 Monsey Boulevard, Monsey, NY:   On or about 5/30/23,  Two employees wearing sneaker used pneumatic nail guns  for roof repair work and the employer did not ensure that employees used appropriate protective footwear (e.g., safety shoes or equivalent).   Because abatement of this violation is already documented in the inspection file, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.

29 CFR  1926.102(a)(1):   Employees did not use eye and face protection equipment when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:   a) Regency Village Apartments , 12-22 Monsey Boulevard, Monsey, NY:   On or about 5/30/23,  four employees  performing  roof repair work used pneumatic nail guns and the employer did not ensure that eye protection (e.g., safety glasses or equivalent) was used by employees exposed to eye loss/eye injuries due to struck by hazards.  Because abatement of this violation is already documented in the inspection file, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.

29 CFR  1926.404(b)(1)(i): Employer did not use either ground fault circuit interrupters as specified in paragraph (b)(1)(ii) of this section, or an assured equipment grounding conductor program as specified in paragraph (b)(1)(iii) of this section to protect employees on construction sites.  a) Regency Village Apartments , 12-22 Monsey Boulevard, Monsey, NY :   On or about 5/30/23, an electric-powered air compressor used for roofing work was connected to a wall outlet inside the entrance using extension cords but the employer did not use either a ground fault circuit interrupter or an assured equipment grounding conductor program.   Because abatement of this violation is already documented in the inspection file, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.
