29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b).  On or about June 1, 2023, employees were exposed to a fall hazard greater than 6 feet while performing roofing work without fall protection.  Gustavo Barragan Bernardino was previously cited for a violation of this Occupational Safety and Health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1540202, citation number 1, Item number 1 and was affirmed as a final order on 9/23/2021 with respect to a workplace located at 6215 Marsh Creek Ln, Manvel, TX, 77578.

29 CFR  1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder.     On or about June 1, 2023, employees were exposed to a fall hazard while accessing the roof with a ladder that was not secured at the top with a grasping device.  Gustavo Barragan Bernardino was previously cited for a violation of this Occupational Safety and Health standard 29 CFR 1926.1053(b)(1), which was contained in OSHA inspection number 1512790, citation number 1, Item number 3 and was affirmed as a final order on 6/11/2021 with respect to a workplace located at 24403 Blairburry Dr., Katy, TX 77493.
