OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from the hazard of high ambient heat while performing jobs duties.  On or about and at times prior to, June 13, 2023, employees were exposed to the hazard of high ambient heat from direct sun during the performance of their job duties, including sand blasting inside a manhole, erecting/dismantling equipment, loading the hopper with 50-pound bags of sand, and confined space attendant duties. National Weather Service issued a heat advisory for most of Central Texas, where both Austin and New Braunfels, are located , on the day of the incident. During the day, the high temperature was 95�F(35�C), the heat index was 107�F(42�C), the relative humidity was 56%, and the estimated WBGT was 80�F(26.7�C), while employee performed a heavy workload. Such exposures are likely to lead to the development of serious heat-related illnesses such as, but not limited to, heat cramps, heat stress, heat exhaustion, and heat stroke.

29 CFR  1910.151(b): There was neither an infirmary, clinic, or hospital used for the treatment of all injured employees in near proximity to the workplace nor a person or persons adequately trained to render first aid.  On or about June 13, 2023, and at times prior thereto, employees were working in a rural location without a trained First aid/CPR person onsite and emergency services/facilities were not in proximity.
