29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met (Construction Reference: 1926.59):   On or about May 6, 2023, employees performed roof repairs using chemical products including but not limited to Gaco S4200 which contained corrosive and combustible ingredients.  A written hazard communication program was not developed to promote the safe handling and use of the hazardous chemical products.

29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:  On or about May 6, 2023, employees engaged in roofing activities on a metal building were not wearing eye protection in the following instances:  (a) while using screw guns to secure the metal material;  (b) while using Gaco S4200, a corrosive.

29 CFR 1926.760(a)(1): Each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems.  On or about May 6, 2023, employees were working on a metal roof installing screws and sealant without fall protection from heights greater than 15 feet.

29 CFR 1904.39(a)(2): Basic Requirement. Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA.  On or about May 6, 2023, an employee sustained injuries from a fall resulting in an in-patient hospitalization.  The employer did not report the hospitalization to OSHA.
