29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.   On or about June 14, 2023, at the above addressed jobsite, an employee using a pneumatic nail gun was not utilizing eye protection, thereby exposing the employee to hazards associated with eye injuries.

On or about June 14, 2023, at the above addressed jobsite, employees performing residential roofing operations, seven (7) feet five (5) inches above ground, were not protected from falls, thereby exposing the employees to fall hazards.

29 CFR  1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:(a)  a. On or about June 14, 2023, at the above addressed jobsite, a worker used a portable extension ladder for access to an upper landing surface to perform gutter installation operations and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access exposing the worker to a fall height of seven (7) feet five (5) inches.

29 CFR  1926.503(b)(1):The employer did not verify compliance with paragraph (a) of this section by preparing a written (training) certification record including the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer.  On or about June 14, 2023, the employer failed to certify that employees had been trained to recognize and minimize fall hazards.  Employees were exposed to fall hazards of 7 feet, 5 inches  high while performing roofing activities on a residential structure without properly using fall protection.
