Garden center area: On or about June 20, 2023, and at times prior thereto the employer exposed employees to potential struck-by and laceration hazards in that the employer had not done the required workplace hazard assessment through a written certification in accordance with the standard.

Garden center area: On or about June 20, 2023, the employer exposed employees to puncture hazards in that PPE was not provided at no cost to employees while handling Robellini palm trees.

29 CFR 1904.41(a)(2): The establishment had 20 or more but fewer than 250 employees at any time during the previous calendar year, and the establishment was classified as an industry listed in appendix A to subpart E of this part but did not electronically submit information from OSHA 300A Summary of Work-Related Injuries and Illnesses to OSHA or OSHA's designee. The employer did not submit the information once a year, no later than the date listed in paragraph (c) of this section of the year after the calendar year covered by the form:  a.  Earthworks Unlimited of Florida, LLC located at 12501 Beach Boulevard, Jacksonville, FL 32246:  On or about June 20, 2023, and times prior thereto, the employer failed for calendar year 2022, to electronically submit information from the OSHA Form 300A or equivalent by March 2, 2023.  The establishment employed approximately 26 employees and was classified in the North American Industrial Classification System as 444220 during calendar year 2022.
