OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to tip-over/roll-over and loss of control hazards while driving a zero-turn radius riding lawn mower:  (a) 7966 Lincoln Way West, Saint Thomas, Pennsylvania - Employees operated a John Deere ZTrak Pro Series Gas Z915B 54-inch zero-turn riding mower to cut the grass on the property, and the employer did not ensure that employees used the seatbelt and rollover protective structure (ROPS), including while mowing the hillside between the entrance driveway and the creek to the east of the driveway, exposing employees to getting separated from the mower and caught under the mower in a tip-over/roll-over or loss of control event, on or about July 4, 2023.  Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR  1904.39(a)(1): The employer did not report within 8-hours the death of an employee resulting from a work-related incident:  (a) 7966 Lincoln Way West, Saint Thomas, Pennsylvania - An employee died on July 4, 2023 around 11AM after a John Deere ZTrak Pro Series Gas Z915B 54-inch zero-turn riding mower landed on top of the employee, and the employer failed to report to OSHA this work-related death within eight hours after the death.  (The employer reported the death to OSHA on July 5, 2023 at 11:10AM.)  Corrected during the inspection.
