29 CFR 1926.21(b)(2): Each employee engages in cutting a wood beam with a gas-powered cut-off machine was not trained to recognize and avoid unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. Site: 142-34 56th Road, Flushing, NY 11355. a.) On or about July 6, 2023, employees working on top of a 7-feet concrete wall cutting wood beams with a gas-powered cut-off saw were not trained to recognize kick-back hazards associated with using the gas-powered machine. Abatement certification is required pursuant to 29 CFR 1903.19.

29 CFR 1926.300(a): Hand tool(s), power tool(s) or similar equipment were not maintained in a safe condition: Site:142-34 56th Road, Flushing, NY 11355. a.) On or about July 6, 2023, employee cutting off wood beams from a 7-feet high concrete wall was struck-by a circular saw. The employer provided the employee with a size 12-inch blade rated for 5000 RPM to operate in a saw that uses a size 14-inch blade and operates at an RPM over 5000. Abatement certification is required pursuant to 29 CFR 1903.19.
