29 CFR  1926.100(a):Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  a) On June 21, 2023, employee was not protected from falling items including but not limited to rock or soil while working without a protective helmet in an excavation without cave-in protection and an excavator operating.  NOTE - Abatement certification is required for this item.

29 CFR  1926.652(a)(1):Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c).  a) On June 21, 2023 and days prior the employer did not ensure that an employee was protected from cave-in hazards when working in an approximate 8 foot deep trench with near vertical walls consisting of loose rock and dirt.  NOTE - Abatement certification AND documentation are required for this item.
